By accessing or using Tripstree (the "Service"), you agree to these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms are meant to be readable and practical. They do not replace independent legal advice.

1. Definitions

In these Terms:

  • Service: the Tripstree platform, including the website, related applications, and any features that allow you to create and share a travel wall.
  • User: any person who accesses or uses the Service, whether they create an account or view someone else's wall.
  • Account: a personal Tripstree account created by a User to build and manage a travel wall.
  • User Content: any content submitted, uploaded, or displayed via the Service by a User, including text, images, country selections, dates, and other wall elements.
  • We / Us / Our: the operator(s) of Tripstree.

2. Acceptance of the Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

3. Eligibility and Account Registration

3.1 Account Creation

When you create an account, you agree to provide accurate, current, and complete information, and to update it if it changes. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3.2 Account Security

You must notify us promptly at admin@tripstree.com if you suspect any unauthorized access to your account. We reserve the right to suspend or terminate accounts that appear compromised, misused, or in violation of these Terms.

4. User Responsibilities

As a User of Tripstree, you agree to:

  • Ensure that all information you submit is accurate to the best of your knowledge.
  • Only upload content (including photos and text) that you have the right to use and share.
  • Respect the privacy and rights of other people whose images or information may appear in your content.
  • Comply with all applicable laws and regulations when using the Service.

You are fully responsible for the content you create and share on your wall and for any consequences arising from that content.

5. User Content and Ownership

5.1 Your Ownership

You retain all rights to the User Content you submit to the Service (such as your photos, notes, and wall design), subject to the rights you grant to us below.

5.2 License to Us

By submitting User Content to Tripstree, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely as needed to operate, maintain, improve, and promote the Service. This includes displaying your wall to visitors when they access your link.

5.3 Representations

You represent and warrant that:

  • You have all necessary rights to submit the User Content and grant the above license.
  • Your User Content does not infringe or violate any third-party rights (including privacy, publicity, or intellectual property rights).

6. Prohibited Uses

You agree not to use the Service to:

  • Upload or share content that is illegal, defamatory, hateful, harassing, threatening, sexually explicit involving minors, or otherwise abusive.
  • Upload or share content that incites violence, promotes discrimination, or glorifies self-harm or serious criminal activity.
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Attempt to probe, scan, or test the vulnerability of the Service, or to circumvent any security or authentication measures.
  • Use the Service to distribute malware, spam, or other harmful or unsolicited content.

We reserve the right (but are not obligated) to review, remove, or restrict access to User Content that we reasonably consider to be in violation of these Terms.

7. Service Availability and Modifications

We aim to keep Tripstree available and functioning, but we do not guarantee uninterrupted or error-free operation. Maintenance, updates, or technical issues may lead to temporary interruptions.

We may modify or discontinue part or all of the Service (for example, features, pricing tiers, or visual design) at any time, with or without notice, provided that such changes are reasonable for a service of this nature. If you have paid subscriptions, we will make reasonable efforts to inform you in advance of changes that materially affect your use of the Service.

8. Pricing, Subscriptions, and Payments

8.1 Pricing

Some features of Tripstree may be offered on a paid basis (for example, premium themes, higher upload limits, or additional customization options). Pricing details are displayed within the Service and may change from time to time.

8.2 Billing and Renewal

If you purchase a subscription, you authorize us and our payment processor to charge you the applicable fees on a recurring basis (e.g., monthly or annually), until you cancel. You are responsible for keeping your billing information accurate and up to date.

8.3 Cancellations and Refunds

You may cancel a subscription at any time through the account or billing settings provided by the Service. Unless otherwise stated, fees are non-refundable, including for partially used periods. In exceptional cases (such as major outages), we may, at our discretion, offer credits or partial refunds.

9. Tripstree Intellectual Property

The Service, including its design, logo, branding, software, and underlying code, is owned or licensed by us and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or internal business purposes.

You agree not to:

  • Reproduce, modify, distribute, or create derivative works based on the Service, except as expressly permitted by us.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law.

10. Disclaimers and Limitation of Liability

10.1 Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we do not make any warranties or representations, express or implied, about the Service, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 Limitation of Liability

To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of (or inability to use) the Service.

Where our liability cannot be excluded under applicable law, it will be limited to the amount you have paid to us for the Service during the twelve (12) months immediately preceding the event giving rise to the claim, or, if you have not paid any fees, to a reasonable amount not exceeding a typical monthly subscription fee.

11. Third-Party Services and Links

The Service may contain links to third-party websites or services, or may integrate with third-party tools (for example, analytics or payment processors). We do not control and are not responsible for the content or practices of these third parties. Your use of third-party services is at your own risk and may be subject to separate terms and policies.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Modified" date at the top of this page and may provide additional notice, such as an in-app message or email. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by and interpreted in accordance with the laws of the Province of Québec and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or your use of the Service shall be submitted to the exclusive jurisdiction of the courts located in the Province of Québec, Canada.

14. Termination

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access to the Service, with or without notice, if:

  • You violate these Terms;
  • Your use of the Service creates risk or potential legal exposure for us; or
  • We decide to discontinue the Service in whole or in part.

Upon termination, your right to use the Service will cease immediately. We may retain certain information as described in our Privacy Policy, for example where required by law or for legitimate business purposes such as security or backup.
